ACCEPTABLE USE POLICY

This Acceptable Use Policy ("Policy") is part of our Terms and Conditions ("Legal Terms") and should therefore be read alongside our main Legal Terms:

When you use the Services, including any AI-powered tools, automation features, messaging tools (including SMS and email), or integrations provided through GriffinCRM or its third-party technology partners (including GoHighLevel), you warrant that you will comply with this document, our Legal Terms, and all applicable laws and regulations.

You are solely responsible for your use of the Services, including all communications sent through the platform, and for ensuring compliance with applicable marketing, privacy, consumer protection, and data protection laws, including but not limited to the TCPA, CAN-SPAM Act, GDPR, and other applicable regulations.

Your continued use of our Services implies acceptance of these Legal Terms.

WHO WE ARE

We are DutchCrew LLC, doing business as GriffinCRM ("Company", "we", "us", or "our"), a company registered in Georgia, United States.

GriffinCRM operates using third-party infrastructure and software providers, including GoHighLevel. Your use of GriffinCRM must also comply with the acceptable use policies and terms of those third-party providers.

USE OF THE SERVICES

When you use the Services, you warrant that you will comply with this Policy and all applicable laws.

You may not:

• Systematically retrieve data or other content from the Services to create a collection, compilation, database, or directory without written permission.
• Make any unauthorized use of the Services, including collecting usernames and/or email addresses for unsolicited communications.
• Circumvent, disable, or interfere with security-related features.
• Trick, defraud, or mislead us or other users.
• Engage in automated scraping, data mining, bots, or extraction tools without authorization.
• Attempt to access another user’s account or subaccount without authorization.
• Reverse engineer or attempt to access source code.
• Sell, lease, sublicense, share, or otherwise transfer your account or access credentials.

• Use the Services to send unsolicited SMS, MMS, email, voicemail drops, or other communications without proper prior express consent where required by law.
• Use purchased, rented, scraped, or third-party lead lists without documented lawful consent.
• Use the Services to send high-volume messaging campaigns that violate carrier rules, spam regulations, or messaging provider requirements.
• Circumvent carrier registration, A2P 10DLC requirements, or messaging compliance safeguards.
• Misrepresent your identity, sender information, or business affiliation in communications sent through the platform.
• Use the Services for phishing, deceptive marketing, pyramid schemes, or misleading offers.

SUBSCRIPTIONS

If you subscribe to our Services, you agree that you may not:

• Provide access to the Services to unauthorized third parties.
• Intercept or access data not intended for you.
• Damage, alter, or delete another user’s data.

• Create multiple accounts to bypass subscription limits, usage limits, or billing restrictions.
• Resell the platform or create white-labeled versions without a separate written reseller agreement.

AI PRODUCTS

When using AI features, you may not:

• Use AI to generate unlawful, deceptive, or misleading content.
• Use AI in ways that violate privacy laws or discriminate unlawfully.
• Use AI outputs without reviewing and validating accuracy.

AI-generated outputs are provided “as is.” You are solely responsible for reviewing, editing, and approving AI-generated content before use in customer communications or business decisions.

ARTIFICIAL INTELLIGENCE

We aim to use AI responsibly to enhance automation and productivity.

Nothing in this Policy creates a fiduciary duty or guarantees regulatory compliance on your behalf. Compliance remains your responsibility as the user of the platform.

Enforcement may include warnings, suspension, termination, or legal action.

We reserve the right to suspend messaging capabilities immediately if carrier violations, spam complaints, or abuse reports are received.

CONTRIBUTIONS

“Contributions” include all content, contact data, customer data, files, messages, media, and information uploaded or transmitted through the Services.

You warrant that:

• You have lawful rights to all data uploaded.
• You have obtained all necessary consents to contact individuals.
• Your data collection practices comply with applicable privacy laws.

You are solely responsible for maintaining records of consent for all marketing communications sent through GriffinCRM.

We are under no obligation to monitor user content but reserve the right to remove content or suspend accounts where violations occur.

PROHIBITED GOODS & SERVICES

You may not use the Services to promote or facilitate:

• Illegal goods or services
• Controlled substances
• Weapons or firearms
• Fraudulent schemes
• Stolen goods

• Payday lending, debt relief scams, crypto pump schemes, or other high-risk financial promotions without prior written approval.
• Adult content businesses, escort services, or sexually explicit services.
• Any industry restricted by messaging carriers or payment processors.

REPORTING A BREACH

We may also suspend accounts upon notice from carriers, regulators, law enforcement, or third-party providers without prior warning.

CONSEQUENCES OF BREACH

We may:

• Issue warnings
• Remove content
• Suspend messaging
• Suspend or terminate accounts
• Report unlawful conduct

We may also permanently block sender IDs, domains, phone numbers, or subaccounts associated with abuse.

We disclaim liability for actions taken in response to violations.

DISCLAIMER

DutchCrew LLC is not responsible for:

• The legality of your marketing practices
• The accuracy of user-provided data
• Carrier filtering or message delivery failures
• Regulatory fines resulting from your misuse

You agree to indemnify and hold harmless DutchCrew LLC from claims arising from your marketing activities, communications, or misuse of the platform.

We reserve the right to update or modify this Acceptable Use Policy at any time. Changes become effective when posted. Continued use of the Services after changes are posted constitutes acceptance of the updated Policy.
